Welcome to TechneArt.org, owned and operated by TechneArt, LLC (“TechneArt,” “we,” “us,” or “our”).These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile applications, and services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.If you do not agree, you must discontinue use of the Platform immediately.

1. Overview

TechneArt.org operates as an online marketplace connecting independent artists, creators, and vendors (“Vendors”) with customers (“Buyers”).TechneArt does not manufacture, handle, store, or ship any products and is not a party to transactions between Buyers and Vendors.

All Vendors operate as independent contractors, not employees, agents, or representatives of TechneArt.Each Vendor is solely responsible for their listings, fulfillment, and compliance with applicable laws.

2. Relationship of Parties

By registering as a Vendor or Buyer, you acknowledge and agree that:

  • TechneArt is not a seller, supplier, manufacturer, or shipper of goods.
  • TechneArt does not guarantee product quality, availability, or delivery timelines.
  • Vendors are solely responsible for their goods, services, representations, and compliance with law.
  • TechneArt is not liable for any disputes, damages, or losses arising from transactions between users.

This Agreement does not create a joint venture, partnership, employment, or agency relationship between TechneArt and any Vendor or Buyer.

3. Vendor Obligations

Vendors using the Platform agree to:

  • Provide accurate and lawful product descriptions, pricing, and delivery timelines.
  • Fulfill orders in a timely and professional manner.
  • Comply with all applicable business, tax, consumer protection, and shipping regulations.
  • Handle packaging and delivery securely to avoid damage.
  • Maintain proof of shipment for all physical goods.

Vendors agree that TechneArt.org shall not be held responsible for their conduct, communication, delays, or contractual performance.

4. Buyer Responsibilities

Buyers agree to:

  • Review all product descriptions before purchase.
  • Provide accurate shipping and contact details.
  • Communicate respectfully and promptly with Vendors and TechneArt staff.

All purchases are final except as specifically described in Section 8 (Refund Policy).

5. Payments and Fees

Payments are processed through third-party payment gateways.By completing a transaction, you authorize those processors to handle funds in accordance with their terms.TechneArt may charge platform fees, commissions, or service fees, which are disclosed prior to purchase or sale.

TechneArt reserves the right to withhold or delay disbursement of funds in cases of suspected fraud, chargebacks, or policy violations.

6. No Agency or Employment

Vendors are independent business operators.They are not employees, partners, or agents of TechneArt and may not represent themselves as such.TechneArt does not provide benefits, insurance, or tax documentation for Vendors.Vendors are fully responsible for their own business operations and tax obligations.

7. Limitation of Liability

To the fullest extent permitted by law:

  • TechneArt, LLC, its affiliates, officers, and employees are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or any transaction between users.
  • TechneArt is not responsible for product defects, delivery failures, misinformation, copyright infringement, or property damage caused by Vendors.
  • TechneArt’s total liability in any matter shall not exceed the total fees paid to TechneArt in the six (6) months preceding the claim or Fifty U.S. Dollars ($50), whichever is greater.

By using this Platform, you agree to indemnify and hold harmless TechneArt, LLC from all claims, damages, and losses related to your use, business practices, or violations of these Terms.

8. Return & Refund Policy

8.1 No Refund Policy

All sales made through TechneArt.org are final.Refunds, returns, or exchanges are not permitted except in cases of verified damage upon delivery.

8.2 Exceptions for Damaged Goods

Refunds or replacements will only be issued if:

  1. The Buyer submits a claim to support@techneart.org within seven (7) calendar days of delivery, and
  2. The Buyer provides photo evidence showing:
    • The damaged item
    • The packaging
    • The shipping label (with tracking number visible)

Claims without photographic evidence or made after the 7-day period will be automatically denied.Once verified, TechneArt may issue a refund or replacement at its sole discretion.

8.3 Digital Goods

Digital products are non-refundable once accessed or downloaded, unless the file is proven defective.

8.4 Non-Delivery

If an order never arrives, Buyers must contact TechneArt for investigation.Once non-delivery is verified, a refund or replacement may be issued.

9. Intellectual Property

All content on TechneArt.org — including trademarks, logos, images, and text — is owned or licensed by TechneArt, LLC.Vendors retain rights to their original works but grant TechneArt a non-exclusive, royalty-free license to display and promote listings.

Users may not reproduce, copy, or exploit any part of the Platform without express written permission from TechneArt.

10. Prohibited Activities

Users may not:

  • List or sell counterfeit, stolen, or illegal goods
  • Infringe on intellectual property rights
  • Manipulate reviews, pricing, or sales data
  • Use the site for spam, fraud, or harassment
  • Attempt to hack, disrupt, or scrape the Platform

Violation of these rules may result in account suspension or termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless TechneArt, LLC, its officers, employees, affiliates, and licensors from any and all claims, liabilities, damages, losses, and expenses (including attorney fees) arising out of or connected to:

  • Your use of the Platform,
  • Your breach of these Terms,
  • Your products, listings, or business operations, or
  • Any violation of applicable law or third-party rights.
12. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of the Puerto Rico, without regard to conflict of law principles.All disputes shall be resolved exclusively in the state or federal courts of Puerto Rico.

13. Amendments

TechneArt reserves the right to modify or update these Terms at any time.Changes become effective upon posting to TechneArt.org. Continued use of the Platform constitutes acceptance of any revised Terms.
